Privacy Policy

Effective: September 28, 2026

This Privacy Policy explains how Rothwells Capitol, doing business as Nevada Water Damage ("Nevada Water Damage," "we," "us" or "our"), collects, uses, discloses, retains and protects information about you when you visit nevadawaterdamage.com and its Spanish-language pages, submit a request, use our damage check, chat with our website assistant, call or text one of our telephone numbers, or otherwise communicate with us. It also serves as our privacy notice under Chapter 603A of the Nevada Revised Statutes (NRS). Please read it carefully. By using the Site or contacting us, you acknowledge that you have read and understood the practices described in this Policy. If you do not agree with them, please do not use the Site; you can still reach us by telephone.

1. Who we are and what this Policy covers

Operator. The Site is operated by Rothwells Capitol, doing business as Nevada Water Damage, a restoration company located at 3011 S Valley View Blvd, Las Vegas, NV 89102. We provide water damage mitigation and restoration, mold inspection and remediation, fire and smoke damage restoration, sewage and biohazard cleanup, asbestos testing, contents pack-out, board-up and tarping, storm damage response, reconstruction and commercial restoration across the Las Vegas valley, in English and Spanish. We are an IICRC Certified Firm (#261729) and are licensed and insured in Nevada.

Scope. This Policy applies to personal information we collect through the Site, through the forms, questionnaire, pop-up and chat assistant on the Site, through the telephone numbers published on the Site and in our advertising, through text messages and emails you send us in connection with a request, and through other communications that refer to this Policy.

What this Policy does not cover. This Policy does not govern the practices of third parties we do not control, such as insurance companies, review platforms, social networks, map providers, government agencies or other websites that we link to, even if you reach them from the Site. Information you give us at your property in the course of a restoration job, such as information in a signed work authorization or service agreement, is also subject to that agreement. If an agreement you sign with us contains privacy terms that differ from this Policy, the agreement controls for that job.

How the Site is built. The Site is built and hosted for us by our website provider, YelloPost, on servers located in the United States. The Site does not offer user accounts or logins, does not accept online payments and does not sell anything online. Its purpose is to provide information about our services and to let you ask us for help.

2. Definitions

In this Policy, the following terms have the meanings below. Other capitalized or quoted terms have the meanings given where they first appear.

  • "Site" means nevadawaterdamage.com, including its Spanish-language pages under /es/, plain-text versions of its pages and any other page that links to this Policy.
  • "Personal information" means information that identifies, relates to or can reasonably be linked to a particular individual or household, such as a name, telephone number, email address, property address or the content of a call. It includes "covered information" as defined in NRS 603A.320 to the extent that definition applies.
  • "Request" means any form submission, damage check summary, pop-up form submission, chat conversation in which you provide your contact details, telephone call, voicemail, text message or email through which you ask us for information or service.
  • "Service provider" means a company that processes personal information on our behalf to help us operate the Site and our business, and that is not permitted to use it for its own unrelated purposes.
  • "Browser storage" means small pieces of information that the Site saves in your web browser using the browser's local storage or session storage features. It is similar in purpose to a cookie but is not sent to our servers with every page request.
  • "Cookie" means a small text file placed in your browser by a website or by a third-party service loaded on a website.

3. Summary of our practices

This summary highlights the key points of this Policy. It is not a substitute for the full Policy, which controls.

  • We collect the information you choose to give us when you ask for help, plus limited technical information from your browser and details about calls to our numbers.
  • We use it to respond to you, provide and document restoration services, work with your insurer or property representatives when appropriate, keep records, protect the Site from abuse and measure how people find us.
  • Calls to our published numbers are announced as possibly recorded, and are recorded, transcribed and logged.
  • Analytics and advertising measurement tools load by default when you use the Site. Our privacy choices banner tells you this on your first visit and lets you turn them off at any time by choosing "Essential only."
  • We do not sell personal information. We do not share it for other companies' own marketing.
  • We share information with service providers who help us run the Site and our business, and with insurance companies and others involved in your job when you ask us to or when needed to perform or bill for the work.
  • Nevada residents may direct us not to sell their covered information and may ask to review or correct it. Residents of other states may have additional rights under their state laws, to the extent those laws apply to us.

4. Information you provide to us

Most of the personal information we have comes directly from you, when you ask us for help. What we collect depends on how you contact us and what you choose to share.

Request forms. The request forms on the Site ask for your name and telephone number, and allow you to add an email address, your ZIP code, the type of damage you are dealing with and a message. When you send a form, we also record the page you sent it from and whether you were viewing the English or Spanish version of the Site, so that we know what you were reading and which language to use when we respond.

Damage check. Our 30-second damage check is a short questionnaire that asks about your situation, such as the source of the water, when the damage started or was discovered, how large an area is affected and whether you have insurance. When you send a request after completing the damage check, a summary of your answers is sent with your request so that the person who calls you back already understands your situation.

Before-you-go pop-up. Some pages may show a pop-up form when it appears you are about to leave the page. It works like our other request forms and collects the same kinds of information. You can close it without providing anything.

Chat assistant. When you use our chat assistant, Dash, we receive the content of the conversation, including anything you type. If you give your name and telephone number in the chat, the conversation is emailed to our team so that we can follow up. Section 7 describes the chat assistant in more detail.

Text a photo. The "Text a photo" link on the Site opens the text messaging app on your own device, addressed to our telephone number. Nothing is sent until you choose to send it. If you send a message or photos, we receive them along with your telephone number, as with any text message.

Telephone calls and voicemail. When you call us, we receive the information you share on the call and in any voicemail you leave, together with the call details described in Section 6.

Emails and other messages. If you email us, write to us or send us documents, we receive the contents of your message, your contact details and anything you attach.

Information for your job. If you become our customer, we collect the information reasonably needed to perform and document the work, such as the property address, access instructions, the names and contact details of the people we should coordinate with, information about your insurance carrier and claim, photographs and notes documenting the damage and our work, and billing information. This information may be collected at your property and is also subject to your signed agreement with us.

Information about other people. If you give us information about another person, such as a tenant, a family member, a property manager or an insurance adjuster, please make sure you have their permission to do so.

Please do not send us Social Security numbers, bank account or payment card numbers, passwords, or medical records through the Site, the chat assistant or text messages. We do not need that information to respond to a request, and the Site does not accept payments.

5. Information collected automatically

When you use the Site, some information is collected automatically by your browser, by our hosting and security providers, and, by default unless you turn them off, by analytics and advertising measurement tools.

Server and security logs. Like virtually all websites, the servers that host the Site and the security services that protect it receive technical information that your browser sends with each request, such as your IP address, the type of browser and device you are using, the page you requested, the page that referred you, and the date and time of the request. This information is used to deliver pages, keep the Site secure, diagnose problems and prevent abuse.

Advertising click identifiers. If you reach the Site by clicking an online advertisement, the page address may include a click identifier added by the advertising platform (for example, a "gclid" value from Google). The Site reads that identifier to recognize that you arrived from an advertisement, so that it can show you, and route your call through, a telephone number that we use to measure advertising results. The Site remembers that you arrived from an advertisement using browser storage, so that the same number is shown to you on later pages and visits. This happens whether or not you accept analytics, because it is how our advertising telephone numbers work. It does not by itself identify you by name.

Browser storage. The Site uses browser storage to remember your choices and keep the Site working as you expect. Section 9 lists each use.

Analytics and advertising measurement. By default when you use the Site, the Site loads Google Tag Manager, which may load Google Analytics 4 and Google Ads conversion measurement. These tools use cookies and similar technologies to collect information about your visit, such as pages viewed, how you arrived, how long you stayed, the approximate location derived from your IP address, device and browser information, and whether you took actions such as submitting a form or tapping a telephone number. Our privacy choices banner appears on your first visit and lets you turn these tools off by choosing "Essential only." Section 10 explains these tools and your choices.

Third-party resources. Some parts of the Site are delivered by third parties whose servers receive your IP address when your browser requests them. Section 11 lists them.

6. Telephone calls, recording and text messages

Call-tracking numbers. The telephone numbers published on the Site and in our advertising are call-tracking numbers. Calls to them are connected through a call-tracking service that forwards the call to our team. This lets us know which pages and advertisements lead people to call us, and it allows us to keep an accurate record of requests for service.

Recording announcement. Callers to our call-tracking numbers hear a brief message that the call may be recorded. If you do not wish to be recorded, you may end the call and contact us by email at [email protected] or by mail instead.

Call recording. We record calls to our call-tracking numbers and voicemails left on them. Nevada law generally requires the consent of all parties to record a telephone call, which is why every call to our tracking numbers begins with a notice that the call may be recorded. By staying on the line after the notice, you consent to the recording. Callers from other states may be subject to the laws of their own states as well.

Transcription. Recorded calls and voicemails are transcribed into text by automated transcription technology. Transcripts may contain errors. We use them so that our team can review what was requested and respond accurately.

Call details. For each call, the call-tracking service logs details such as the calling telephone number, the date and time, the duration, which of our numbers was dialed and whether the call was answered.

Advertising numbers. As described in Section 5, visitors who arrive from an advertisement are shown a telephone number used for advertising, and calls to that number are associated with the advertising that produced them. This helps us understand which advertising works so that we spend our advertising budget responsibly.

Why we use recordings and call information. We use call recordings, transcripts and call details to respond to your request, confirm what was requested and agreed, document emergency calls, train and supervise our team, improve customer service, measure advertising, identify and screen spam and unwanted solicitation calls, resolve disputes and comply with legal obligations.

Text messages. If you text us, including by using the "Text a photo" link, we receive your telephone number and the content of your messages and any photos. We use them to respond to you and to assess and document your job. We do not send marketing text messages. When we text you about your request or job, message and data rates may apply according to your mobile plan. You can reply STOP at any time to stop receiving text messages from us.

Calls and texts you ask for. When you submit a request, you ask us to contact you. Our Terms of Use explain the contact you authorize. Consent to receive calls or texts is never a condition of purchasing our services, and you can tell us at any time to stop contacting you by a particular method.

7. Our website chat assistant (Dash)

What it is. Dash is an automated chat assistant on the Site, powered by YelloPost AI, an artificial-intelligence service provided through our website provider, YelloPost. Dash is not a person. It generates replies automatically based on what you type.

What is collected. The messages you type, and Dash's replies, are processed by YelloPost AI to generate responses. If you give Dash your name and telephone number, the conversation is emailed to our team so that a person can follow up with you, and a copy is kept with the record of your request. Our website provider may also receive the conversation as part of the lead notifications described in Section 15.

How it is used. We use chat conversations to respond to your request, to understand what you need before we call you, to review and improve the answers the assistant gives, and to protect the chat from abuse.

What not to share. Please do not type sensitive information into the chat, such as financial account numbers, Social Security numbers or detailed medical information. If you mention health information, such as symptoms you believe are related to mold or water damage, we use it only to respond to your request. See Section 21.

Accuracy. Chat responses are general information and may be incomplete or inaccurate. They are not binding on us. Our Terms of Use explain this further.

8. Automated screening and bot protection

Screening. To protect our team and our customers, requests submitted through the Site are automatically screened for spam, abuse, duplicate submissions and unsolicited sales solicitations. Screening is performed by automated rules and tools operated for us by our website provider. A message that the screening flags may be held for review by a person before it is delivered or acted on. Screening is used only to decide how a message is handled. It is not used to make decisions that produce legal or similarly significant effects about you, such as decisions about credit, housing, insurance or employment.

If your request is held. If you submitted a genuine request and have not heard from us, please call us at (702) 213-9556. Our telephone line is answered 24 hours a day, 7 days a week.

Cloudflare Turnstile. Our forms use Cloudflare Turnstile, a bot-detection check that usually runs invisibly in the background. To determine whether a submission is coming from a person or an automated program, Turnstile processes information about your browser and device and your interaction with the page, and Cloudflare receives your IP address. Cloudflare also provides domain name (DNS) and security services for the Site. Cloudflare processes this information under its own privacy policy.

9. Browser storage and cookies we use

The Site itself does not use browser storage to track you across other websites. It uses browser storage for the following limited purposes, which are necessary for the Site to work as you expect or to remember choices you have made:

  • Local storage: your privacy choice ("Accept all" or "Essential only"), so that the banner does not reappear on every page.
  • Local storage: whether you arrived from an advertisement, so that the correct telephone number is shown to you (see Section 5).
  • Local storage: your accessibility menu settings, such as text size or contrast, if you use the accessibility menu.
  • Local storage: whether you closed a widget or pop-up, such as the chat button or the accessibility button, so that it stays closed.
  • Session storage: whether you have already sent a request during your current visit, so that we do not ask you again or show you the before-you-go pop-up after you have contacted us. Session storage is cleared when you close the browser tab.

Information in local storage stays in your browser until you clear it. You can clear browser storage and cookies at any time through your browser settings. If you do, the Site will treat you as a new visitor, show the privacy choices banner again and forget your accessibility settings.

Cookies placed by analytics and advertising measurement tools are placed by default unless you choose "Essential only." They are described in Section 10.

10. Analytics, advertising measurement and your choices

The privacy choices banner. When you first visit the Site, a banner tells you that analytics and advertising measurement tools load by default and that you can turn them off, and offers two choices: "Accept all" and "Essential only." You can change your choice at any time by selecting the "Privacy choices" link in the footer of any page, which reopens the banner.

Essential only. If you choose "Essential only," the Site stops loading Google Tag Manager, Google Analytics and Google Ads conversion measurement, and the page reloads without them. Your browser remembers this choice using the browser storage described in Section 9, so these tools stay off on later pages and visits unless you change your choice. The Site continues to work, including the forms, the chat assistant, the damage check and the telephone numbers. Our hosting, security and call-tracking services continue to operate as described in this Policy, because they are necessary to provide the Site and respond to calls.

Accept all. By default, and if you choose "Accept all" or simply continue using the Site without making a choice, the Site loads Google Tag Manager, a tool that manages the loading of other measurement tags. Through Google Tag Manager, the Site may load Google Analytics 4, which helps us understand how visitors use the Site, and Google Ads conversion measurement, which helps us understand whether our Google advertising leads to requests and calls. These tools set cookies and collect information about your visit and actions on the Site, which Google processes. Google may combine that information with other information it holds about you, such as information associated with your Google account, according to Google's own policies and your Google settings.

Tracking over time and across websites. Unless you choose "Essential only," Google may collect information about your online activities over time and across different websites, including the Site. If you choose "Essential only," the Site stops loading these tools. Our hosting and security providers, and the third-party resources described in Section 11, receive your IP address when your browser contacts them, as part of delivering those resources.

Google's controls. You can learn about Google's practices and choices at policies.google.com, and you can control ad personalization through your Google account settings. Google also offers a browser add-on for opting out of Google Analytics.

How the choice works with our advertising numbers. Showing an advertising telephone number to visitors who arrive from an ad click happens within the Site, based on the click identifier in the page address, and does not depend on Google Tag Manager.

Browser-level controls. Most browsers let you block or delete cookies and browser storage, and some offer built-in tracking protection. Blocking all storage may cause parts of the Site, such as remembering your privacy choice, to stop working.

11. Third-party resources that receive your IP address

Some content on the Site is loaded from third-party servers. When your browser requests that content, the third party receives your IP address and standard technical information from your browser, and it processes that information under its own privacy policy. These resources are:

  • Google Fonts, which provides some of the typefaces used on the Site.
  • Cloudflare, which provides DNS and security services for our domain and runs the Turnstile check on our forms.
  • The map tile provider for our service-area map. The map is built with the Leaflet library and displays basemap images from Esri. The map loads only when the map section scrolls into view on your screen. If you never scroll to the map, its tiles are not requested. The same service-area information is available as a text list on our Areas page.
  • Google Tag Manager, Google Analytics 4 and Google Ads conversion measurement, which load by default unless you choose "Essential only" in our privacy choices banner.

The Site also contains links to other websites, such as review platforms, insurance companies and government agencies. Those websites receive information from your browser only if you click a link and visit them. See Section 26.

12. How we use personal information

We use personal information for the following purposes:

  • Responding to requests. To answer your questions, call or text you back, and understand the damage you are dealing with, including by reviewing your form, damage check summary, chat conversation, text messages, photos and call recordings.
  • Providing services. To schedule and perform inspections, emergency response, mitigation, remediation, testing, cleaning, pack-out, board-up, reconstruction and related services, and to document conditions and the work performed.
  • Insurance and property coordination. To communicate with your insurance company, adjuster, property manager, landlord or homeowners association when you ask us to, or when it is necessary to perform or bill for the work you requested.
  • Confirmations and service communications. To send you an automatic confirmation of your request if you gave us an email address, and to communicate with you about scheduling, the progress of your job, documentation and billing.
  • Quality and delivery monitoring. To confirm that requests from the Site reach our team, that responses are timely, and that our forms, chat and telephone lines work properly.
  • Measurement and improvement. To understand which pages, services and advertisements lead people to contact us, and to improve the Site, our content, our advertising and our customer service.
  • Training. To train and supervise our team, including by reviewing call recordings and transcripts.
  • Security and abuse prevention. To protect the Site, our forms, our chat assistant, our telephone lines, our team and our customers against spam, fraud, unsolicited solicitation and other abuse.
  • Legal and business purposes. To keep business, tax and accounting records, comply with legal obligations, respond to lawful requests, establish or defend legal claims, enforce our agreements and our Terms of Use, and in connection with a business transfer described in Section 13.

We do not use personal information for purposes that are materially different from those described above without telling you and, where required by law, asking for your consent.

13. How we share personal information

We do not sell personal information, and we do not share it with other companies for their own marketing. We share personal information only as described below.

Service providers. We share personal information with service providers that perform services for us and are expected to keep it confidential and use it only to provide their services to us. They include:

  • Our website provider, YelloPost, which builds and hosts the Site, operates our forms and the screening described in Section 8, and receives copies of lead notifications so that it can monitor delivery and quality.
  • YelloPost AI, the artificial-intelligence service that powers our chat assistant.
  • Email delivery services that send request notifications to our team and confirmation emails to you.
  • Our call-tracking provider, which connects, records and transcribes calls and voicemails to our published numbers and logs call details.
  • Cloudflare, which provides DNS, security and the Turnstile bot check.
  • Google, unless you choose "Essential only," for analytics and advertising measurement as described in Section 10.
  • Providers of the email and other business tools we use to communicate with you, keep records of requests and jobs, and bill for our work, which process information as needed to provide those services to us.

People involved in your job. We share information with your insurance company, insurance adjuster, property manager, landlord or homeowners association when you ask us to, when you authorize it in your agreement with us, or when it is necessary to perform or bill for the work you requested. These parties use the information under their own policies and obligations.

Subcontractors and laboratories. We share information with subcontractors we engage to perform part of the work at your property and with testing laboratories that analyze samples, such as samples taken for mold or asbestos testing, to the extent needed for them to do that work.

Legal and compliance. We may disclose information when we believe in good faith that disclosure is required by law, regulation, subpoena, court order or other legal process; to respond to lawful requests from government authorities; to establish, exercise or defend legal claims; to enforce our agreements; or to protect the rights, property or safety of our customers, our team, the public or us.

Business transfers. If we are involved in a merger, acquisition, financing, reorganization, sale of all or part of our business or assets, or a similar transaction, personal information may be disclosed to the parties involved and transferred as part of the transaction, subject to this Policy or to a notice we provide.

With your direction or consent. We may share information with anyone else when you ask us to or give us permission.

Aggregated or de-identified information. We may use and share information that has been aggregated or de-identified so that it no longer reasonably identifies any individual, for example the number of requests we receive by type of damage.

14. Sale of personal information and targeted advertising

We do not sell personal information for money. We do not sell "covered information" as that term is defined in NRS 603A.333.

Unless you choose "Essential only," Google Ads conversion measurement may allow Google to associate your visit and actions on the Site with our advertising and with information Google holds. Under some state laws, this kind of measurement may be treated as "sharing" for cross-context behavioral advertising or as "targeted advertising." We describe it here so that you can decide. The Site loads it by default, and you can turn it off at any time by choosing "Essential only" through the "Privacy choices" link in the footer. We treat the "Essential only" choice as your opt-out of this measurement. Apart from Google Ads conversion measurement when it is loaded, we do not share personal information for cross-context behavioral advertising.

15. Emails we send and receive

Notifications to our team. Every request submitted through the Site generates an email to our team containing the information you provided. Chat conversations in which you give your name and telephone number are also emailed to our team.

Copies to our website provider. Our website provider, YelloPost, receives copies of lead notifications so that it can monitor whether requests are delivered and handled promptly and whether the forms are working properly.

Confirmation to you. If you include an email address in your request, you will receive an automatic confirmation email, in English or Spanish depending on the version of the Site you used. If you reply to it, your reply comes to us.

No marketing lists. We do not add you to a marketing email list because you submitted a request. If we ever send marketing email, it will include a way to unsubscribe.

16. How long we keep personal information

We do not keep personal information for a fixed period in every case. Instead, we keep it for as long as reasonably needed for the purposes described in this Policy, and then delete it or de-identify it when it is no longer needed. In deciding how long to keep information, we consider:

  • Whether you became a customer, and the time needed to perform, document and stand behind the work, including any warranty obligations.
  • The needs of insurance claims, which may remain open, be reopened or be reviewed long after the work is complete.
  • Tax, accounting, licensing, recordkeeping and other legal requirements.
  • Whether the information is relevant to an actual or potential dispute, claim, investigation or legal proceeding.
  • The need to protect against spam, fraud and abuse.
  • Whether you have asked us to delete the information and whether we are permitted or required to keep it.

Call recordings, transcripts and chat conversations are kept with the record of the request they relate to and are handled under the same criteria. Information in your browser storage stays in your browser until you clear it. Information collected by Google, if you accept analytics, is kept according to Google's retention settings and policies. Backup copies may persist for a limited time after deletion from active systems until they are overwritten in the normal course.

17. How we protect personal information

We use reasonable administrative, technical and physical safeguards designed to protect personal information against loss, misuse and unauthorized access, disclosure, alteration and destruction. These safeguards include:

  • Encrypted connections (HTTPS) between your browser and the Site.
  • Access controls on the systems that hold personal information.
  • Limiting access, on a least-privilege basis, to people who need the information to do their jobs.
  • Requiring our service providers to keep personal information confidential.
  • Automated screening and bot protection on our forms.

No method of transmitting information over the internet, and no method of electronic storage, is completely secure. We cannot guarantee absolute security. Email and text messages in particular are not always encrypted in transit. Please keep this in mind when deciding what to send us, and contact us by telephone if you prefer.

18. Security incidents and breach notification

If we learn of a breach of the security of a system that holds personal information about Nevada residents, we will provide notice as required by NRS 603A.220, in the most expedient time possible and without unreasonable delay, consistent with the legitimate needs of law enforcement and any measures necessary to determine the scope of the breach and restore the reasonable integrity of the system. For residents of other states, we will provide notice as required by the laws that apply. If you believe your information has been compromised through our Site or our communications, please contact us right away.

19. Nevada privacy notice (NRS 603A.300 to 603A.360)

This section, together with the rest of this Policy, is our notice under NRS 603A.340 to consumers who use the Site. It addresses each element required by that law.

Categories of covered information we collect. Through the Site and our online services, we collect the following categories of covered information about consumers who use or visit the Site:

  • First and last name.
  • Telephone number.
  • Email address, if you provide one.
  • Physical address of your property, if you provide it, and ZIP code.
  • Any other identifier that allows a specific person to be contacted, and information about you that is collected online and maintained in combination with those identifiers, such as the content of your request, your damage check answers, your chat conversation, and technical information such as IP address and device and browser information.

Categories of third parties with whom we may share covered information. We may share covered information with the categories of third parties described in Section 13: our service providers (website and hosting, email delivery, call tracking, recording and transcription, the chat assistant service, security and bot protection, and, if you choose "Accept all," analytics and advertising measurement); insurance companies, adjusters, property managers, landlords and homeowners associations involved in your job; subcontractors and testing laboratories; government authorities, courts and others for legal and compliance purposes; and parties to a business transfer.

Reviewing and requesting changes. You may review and request changes to the covered information we have collected about you through the Site by contacting us at [email protected], by calling (702) 213-9556 or by writing to us at the address in Section 30. Section 22 explains how we handle these requests.

How we notify you of material changes. We will notify you of material changes to this Policy by posting the updated Policy on this page with a new effective date, and, for material changes, by providing additional notice on the Site, such as a notice near the top of this page or in the Site footer, for a reasonable period.

Collection over time and across websites. Third parties may collect covered information about your online activities over time and across different websites when you use the Site, because Google Tag Manager and the Google tools described in Section 10 load by default. If you choose "Essential only," those tools are not loaded. See also Section 11 and Section 24.

Effective date. This Policy is effective as of the date shown at the top of this page.

20. Your Nevada right to opt out of the sale of covered information (NRS 603A.345)

Your right. Nevada law gives consumers the right to direct an operator not to make any sale of covered information that the operator has collected or will collect about the consumer. We do not sell covered information as defined in NRS 603A.333. Even so, you may submit a verified request directing us not to sell your covered information in the future, and we will honor it.

How to submit a request. Email your request to our designated address, [email protected], with the subject line "Nevada Do Not Sell Request." Please include your name and the telephone number or email address you used when you contacted us, so that we can locate your information and verify your request. You may also call (702) 213-9556 and we will help you submit the request.

Our response. We will respond to a verified request within 60 days after we receive it. If reasonably necessary, we may extend that period by up to 30 additional days, and we will let you know if we do.

21. Consumer health data

Nevada law (NRS Chapter 603A, as amended by Senate Bill 370 of 2023) provides protections for "consumer health data." Our Site is designed to request information about property damage, not information about anyone's health, and we do not seek consumer health data.

Sometimes visitors choose to mention health information, for example symptoms they believe may be related to mold or water damage, or a condition that makes a situation urgent, in a form, a chat, a call or a text. If you volunteer health information, we use it only to respond to your request and to provide the services you ask for, such as prioritizing a response or taking appropriate precautions at your property. We do not sell it, and we do not use it for advertising. It is kept with the record of your request under the criteria in Section 16. If you would like us to delete health information you volunteered, contact us as described in Section 22.

Please do not share health information with us unless it is relevant to your request. Nothing on the Site is medical advice. If you have health concerns, please talk with a qualified medical professional.

22. How to make a privacy request

What you can ask. You may ask us to tell you what personal information we hold about you, to give you a copy of it, to correct information that is inaccurate, to delete it, or to stop contacting you by a particular method. Nevada residents may also make the requests described in Sections 19 and 20.

How to ask. Email [email protected], call (702) 213-9556 (answered 24 hours a day, 7 days a week), or write to us at the address in Section 30. Please describe your request and tell us how we can reach you.

Verification. To protect your information, we will take reasonable steps to verify your identity before acting on a request, which usually means confirming information you gave us when you contacted us, such as your name, telephone number, email address or property address. We will use the information you provide in a request only to verify and respond to it.

Authorized agents. You may use an authorized agent to make a request on your behalf where the law allows. We may ask the agent for proof of authorization and may ask you to verify your identity directly.

Limits. We may keep information that we are required or permitted by law to retain, such as records of work performed, invoices, insurance documentation and information needed for legal claims, even after a deletion request. Deleting information may also mean we can no longer respond to a pending request or support an insurance claim, and we will tell you if that is the case. We will explain the reason if we cannot fulfill all or part of a request.

Timing. We aim to respond to requests promptly and within the time required by applicable law.

No retaliation. We will not deny you service, charge you a different price or provide a different level of service because you exercised a privacy right.

23. Residents of other states

We are a local business serving the Las Vegas valley, and the Site is intended for people seeking restoration services in Nevada. Residents of other states, such as property owners who live elsewhere, may have rights under the privacy laws of their own states, such as rights to know, access, correct or delete personal information, or to opt out of certain processing.

Some of those laws apply only to businesses that meet certain thresholds, for example based on annual revenue or the number of residents whose information is processed, and may not apply to a business of our size. To the extent a state privacy law applies to us and to your information, we will honor requests made under it. Whether or not a particular law applies, you may contact us with any privacy request using the methods in Section 22 and we will consider it in good faith.

California residents. If the California Consumer Privacy Act applies to our handling of your information, the categories of personal information we collect, the sources, the purposes and the categories of recipients are described in Sections 4 through 15 of this Policy. We do not sell personal information and do not knowingly sell or share the personal information of consumers under 16 years of age. You may exercise any applicable rights using the methods in Section 22.

24. Do Not Track and Global Privacy Control

Do Not Track. Some browsers can send a "Do Not Track" signal. Because there is no common industry standard for how to respond to these signals, the Site does not respond to them.

Global Privacy Control. The Site does not currently read Global Privacy Control signals to change its behavior automatically. The opt-out mechanism we provide is the "Essential only" choice in our privacy choices banner, which you can select at any time through the "Privacy choices" link in the footer. When you choose "Essential only," the Site does not load analytics or advertising measurement. If you send us a privacy request under a law that applies to us, we will honor it as described in Sections 22 and 23.

25. Children and minors

The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from children under 13 years of age, consistent with the Children's Online Privacy Protection Act. If you are a parent or guardian and believe your child under 13 has provided personal information through the Site, contact us and we will delete it.

Individuals under 18 should not submit requests or chat with our assistant without the involvement of a parent or guardian. If there is an emergency at your home and you are under 18, tell an adult, and call 911 if anyone is in danger.

26. Links, review platforms and social media

The Site contains links to third-party websites and services, including Google, Yelp and Facebook, insurance companies, government agencies and other resources. When you follow a link, the third party's own privacy policy governs what it collects. We are not responsible for the privacy practices of websites we do not operate, and we encourage you to read their policies.

Review platforms. The Site links to our profiles on review platforms such as Google, Yelp and Facebook, and may display reviews and ratings from them. If you post a review on one of those platforms, what you post is public and is governed by that platform's terms. Content that appears on our Site or our profiles may also be displayed by those platforms.

27. Spanish-language pages and communications

We provide the Site in English and Spanish, and we serve customers in both languages. The language of the page you are using is recorded with your request so that we can respond in your preferred language. A Spanish translation of this Policy is provided for your convenience. If there is any conflict between the English and Spanish versions, the English version controls.

28. Where your information is processed

We are located in Nevada, and the Site is hosted on servers located in the United States. Our service providers may process information in the United States and, in some cases, in other countries where they or their subcontractors operate. The Site is intended for people seeking services in the Las Vegas valley. If you access the Site from outside the United States, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.

29. Changes to this Policy

We may update this Policy from time to time to reflect changes in the Site, our services, our service providers or the law. When we do, we will post the updated Policy on this page and change the effective date at the top. If we make material changes, we will provide additional notice on the Site as described in Section 19. Changes take effect when posted, unless the notice says otherwise. We encourage you to review this Policy periodically. Your continued use of the Site after a change takes effect means that the updated Policy applies to your use. Changes will not apply retroactively to information in a way that is materially less protective without your consent where the law requires it.
